1. Introduction
Welcome to Explore Kenya (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your use of our website (explore-kenya.com), booking of tours, and any other services we provide. By accessing our website or making a booking, you agree to these Terms.

2. Services
We offer travel planning, guided tours, safari packages, accommodation coordination, transport, and related travel services (collectively, “Services”). All Services are subject to availability, and bookings are confirmed only once you meet our payment and documentation requirements.

3. Booking & Payment

• To make a reservation, you must complete our booking form and provide required personal and travel information.
• Payment terms (deposit, balance, currency) will be clearly communicated for each package.
• We may require a deposit to confirm booking; the balance is due as specified in your booking confirmation.
• We accept payments via the methods listed on our website (e.g., bank transfer, credit card, mobile money).

4. Changes & Cancellations

• By You: If you wish to cancel or modify your booking, you must notify us in writing (e.g., via email). Cancellation or change fees may apply depending on timing and the specific tour.
• By Us: We reserve the right to make changes to itineraries, accommodation, or transport, especially in response to safety concerns, weather, or other force-majeure events. When possible, we will offer a substitute of equal value.
• Refusal of Service: We may refuse or terminate service in certain cases (e.g., inappropriate behavior, failure to provide required documentation).

5. Liability & Risks

• Travel involves inherent risks (wildlife, remote locations, transport, etc.). By booking, you acknowledge and accept those risks.
• We act as an intermediary / tour operator: for third-party services (hotels, flights, transport), liability is limited to what we contractually can control.
• Our total liability for any claim (contractual or tort) is, to the extent permitted by law, limited to the cost of the affected part of the booking.

6. Insurance
We strongly recommend that every traveler carry adequate travel insurance, including but not limited to medical coverage, trip cancellation, and evacuation.

7. Traveler Responsibilities

• Passports, visas, vaccinations, and other travel documentation are your responsibility unless otherwise agreed.
• You must follow local laws and regulations, and instructions from guides / our representatives.
• If you miss a tour component due to your own fault (e.g., arriving late), you may forfeit that portion, and no refund is guaranteed.

8. Complaints / Disputes

• If you have any complaint during the trip, you must notify your local guide or our representative immediately so we can try to resolve it on the ground.
• After your trip, if you wish to make a formal complaint, you must send us a written complaint within 30 days of the trip’s end.
• These Terms are governed by the laws of the Republic of Kenya, and disputes will be submitted to the courts of Kenya.

9. Intellectual Property
All content on explore-kenya.com (text, images, logos) is our property or licensed to us. You may not copy, reproduce, or use our content without our prior written consent.

10. Amendments
We may update these Terms from time to time. We will notify you of material changes by posting them on our website. Your continued use of the Services after such changes constitutes acceptance.

If any provision of these Terms is found to be unenforceable, the remainder will still apply.

This Refund Policy governs cancellations and reimbursements for payments made to Explore Kenya. By booking through us, you accept this policy.

2. Cancellation by Traveler

• Advance Notice: If you cancel your booking anytime before the trip start date, you may receive a full refund minus any non-refundable deposit or costs already committed on your behalf (e.g., hotels, transport).
• No-show / Partial Participation: If you miss part or all of the Services without timely notice, the refund will be prorated by the number of days completed.

3. Cancellation by Explore Kenya

• In the rare event we cancel your trip (e.g., due to force majeure, safety issues, insufficient participants), we will:
  
  1. Offer a full refund for the canceled portion, or
  2. Propose a comparable alternative, or
  3. Offer credit for future travel, based on your preference and our operational capacity.

4. Third-Party Suppliers
Some components of your trip (flights, hotels, activities) are provided by third-party suppliers. Any refunds for such services will be subject to the cancellation and refund policies of those suppliers. We will assist you in claiming eligible refunds, but we cannot guarantee third-party cooperation.

5. Processing Refunds

• Refunds will be made to the same method of payment used for booking, unless otherwise agreed.
• Processing times may vary depending on:
  
  1. The payment method.
  2. Bank procedures (if applicable).
  3. Third-party refund timelines.

• Any bank or transaction fees incurred in processing refunds may be deducted from the refund amount, unless otherwise agreed.

6. Disputed Refunds
If there is a dispute over a refund (e.g., you believe you are owed more than was refunded), please contact us in writing. We will investigate and respond within a reasonable timeframe.

7. Legal Rights
Your statutory rights under Kenyan law, including under the Consumer Protection Act, are not affected by this policy. For example, if we have charged you an illegal fee, you may demand a refund under the Consumer Protection Act.
